Failure of medical prostheses - woman received a six figure compensation sum


Compensation was recovered for a lady who alleged that her medical prostheses had failed and so were said be defective in law. The treatment is relatively new and is somewhat controversial. High Court proceedings were pursued but ultimately settled at a confidential mediation. The litigation and indeed the mediation were fiercely contested by an international manufacturer and the fact, the causation and the legal effect of the defect were all contested.

The claim settled for six figures plus costs without admission of liability and subject to confidentiality provisions.
