Finley's Case


Finley suffers from cerebral palsy.  He was born asphyxiated following several failed attempts at delivery and an eventual caesarean section.  His parents have been traumatised by events.

His mother was 12 days overdue and was of small frame which was significant because Finley was a large baby and delivery was obstructed.  A full admission of both breach of duty and causation has been obtained; the case turned on the number of attempts made by the doctors to deliver Finley prior to the caesarean section, which delayed eventual delivery of an already fatigued baby by 10-15 minutes.

Interim payments have been obtained to provide for care and accommodation needs and the eventual settlement in the case is expected to be in excess of £5m.
