Gemma's Case
was born in 1985 at 29 weeks' gestation and developed quadriplegic cerebral palsy. Her parents first consulted lawyers in 1994 but following initial investigations experts were not supportive of a claim. A FOCIS member law firm took on the case in 2004.
Following substantial further investigations, it became apparent that there was brain damage caused by infection, and that antibiotics had not been administered in a timely manner. Liability was settled at 80% shortly before the case was due to go to trial in 2008.
Interim payments have been secured to fund the purchase of property, care, equipment and therapies.
