Barry's Case 2008

Barry was left paralysed from mid-chest downwards when an operation to correct curvature of the spine went wrong.

When Barry first consulted us, he thought the problem had arisen as a result of a lapse in the monitoring during the operation. However, investigations indicated a failure in surgical technique

Having initially denied liability, the Defendants eventually made an offer to settle for 70% liability. This was rejected on the basis that Barry couldn't have any contributory negligence and it was therefore an all or nothing case, and liability was eventually agreed at 100%

The case settled in September 2008 for an estimated £2.7 million (part lump sum and part periodical payments), a month before it was due to go to trial.
